General Terms and Conditions and consumer information?
§ 1 Scope and provider These General Terms and Conditions apply to all orders placed via the online shop of SGW Simply Great Whisky GmbH, Gleimstraße 28, DE 10437 Berlin, Managing Director: Caroline Schwarz.
The offer in our online shop is aimed exclusively at buyers who are at least 18 years of age.
§ 2 Conclusion of contract
§ 2.1 The product descriptions in the online shop do not constitute a legally binding offer to purchase. Rather, they are a non-binding invitation to order goods from the online shop. By clicking on the ‘Place order’ button, you are submitting a binding offer to purchase.
§ 2.2 We will confirm receipt of your order by sending an automated email immediately after you submit your order, but this does not constitute acceptance of the contract. A binding purchase contract is only concluded when we expressly accept your order by sending a separate order confirmation by email or deliver the goods to you without prior express declaration of acceptance.
§ 3 Prices The prices stated on the product pages include statutory value added tax and other price components and do not include costs for shipping, insurance and payment.
§ 4 Delivery conditions and reservation of self-supply
§ 4.1 Unless otherwise stated in the offer, the delivery time is approximately 3-5 days. If goods that are not in stock need to be reordered, the delivery time is 1-2 weeks.
§ 4.2 If not all of the products ordered are in stock, we are entitled to make partial deliveries at our expense, provided this is reasonable for you.
§ 4.3 If delivery of the goods fails despite three attempts, we may withdraw from the contract. Any payments made will be refunded to you immediately.
§ 4.4 If the ordered product is not available because we are not supplied with this product by our suppliers through no fault of our own or are not supplied in time, we may withdraw from the contract. In this case, we will inform you immediately and, if necessary, suggest the delivery of a comparable product. If no comparable product is available or you do not wish to receive a comparable product, we will refund any payments already made without delay.
§ 5 Terms of payment
§ 5.1 Payment shall be made using the selected payment method.
§ 5.2 If you choose to pay in advance, we will provide you with our bank details in the order confirmation. The invoice amount must be transferred to our account within 10 days. When paying by credit card or direct debit, your account will be debited when the goods are dispatched. When paying by instant transfer or PayPal, payment is made when the order is submitted.
§ 5.3 If you are in default of payment, interest shall be charged on the purchase price at a rate of 5% above the base rate during the period of default. We reserve the right to prove and claim higher damages caused by default.
§ 5.4 When paying by direct debit, you may be required to bear any costs incurred as a result of a payment transaction being reversed due to insufficient funds in your account or due to incorrect bank details provided by you.
§ 6 Retention of title The goods remain our property until the purchase price has been paid in full.
7 Right of withdrawal
§ 7.1 Consumers are entitled to a right of withdrawal in accordance with the following provisions. Consumers are natural persons for whom the purpose of the order cannot be attributed to a commercial, self-employed or freelance activity.

You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods.
To exercise your right of withdrawal, you must inform us (SGW Simply Great Whisky GmbH, Gleimstr. 28, DE 10437 Berlin, email info@greatwisky.de) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post, fax or email). You can use the attached sample withdrawal form for this purpose, but this is not mandatory.
To comply with the withdrawal period, it is sufficient for you to send the notification of your exercise of the right of withdrawal before the expiry of the withdrawal period.
Consequences of withdrawal
If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days of the day on which we receive notification of your withdrawal from this contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period. You shall bear the direct costs of returning the goods. You shall only be liable for any loss in value of the goods if this loss in value is attributable to handling of the goods that is not necessary for testing their condition, properties and functionality.
§ 7.2 The right of withdrawal does not apply to the delivery of goods
- that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer,
- that can spoil quickly or whose expiry date would be quickly exceeded,
- that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery,
- if, due to their nature, they have been inseparably mixed with other goods after delivery;
- for the delivery of alcoholic beverages, the price of which was agreed upon at the time of conclusion of the contract, but which can be delivered at the earliest 30 days after conclusion of the contract and whose current value depends on market fluctuations over which the entrepreneur has no influence;
- as well as for the delivery of audio or video recordings or computer software in sealed packaging if the seal has been removed after delivery:
§ 8 Transport damage
§ 8.1 If goods are delivered with obvious transport damage, please report such defects immediately to the delivery agent and contact us as soon as possible.
§ 8.2 Failure to make a complaint or contact us has no consequences for your statutory warranty rights. However, you help us to assert our own claims against the carrier or transport insurance company.
§ 10 Warranty The statutory warranty rights apply to the items offered in our shop.
§ 11 Final provisions Should any provision of these General Terms and Conditions be invalid, the remainder of the contract shall remain valid. The relevant statutory provisions shall apply in place of the invalid provision.
